‘Intentionally false statements’: Congressman sends criminal referral to DOJ naming Jack Smith, charging perjury * WorldNetDaily * by Bob Unruh

As part of the lawfare assembled by special counsel Jack Smith to use in his attacks on President Donald Trump, he obtained the communications of dozens of members of Congress.

And he testified about those actions before Congress.

But he may not have been truthful, and now House Judiciary Committee Chairman Jim Jordan, R-Ohio, has issued a criminal referral against him that accuses him of making “willfully and intentionally false statements” while testifying under oath to Congress.

A report at ABC said Jordan’s letter to acting Attorney General Todd Blanche said, “The Committee on the Judiciary writes to refer strong evidence that appears to show Jack Smith, former Special Counsel, knowingly made false statements during his December 17, 2025 deposition.”

The dispute is over what Smith said under oath about his access to phone records of 44 lawmakers who communicated with Trump and other members of the White House relating to 2020 election integrity concerns.

Jordan said, “This information calls into question the completeness and accuracy of statements that Mr. Smith made under oath to the Committee regarding his team’s access to the content of Members’ text messages.”

While Smith “gave the impression that neither Mr. Smith nor his team had access to the content of members’ privileged text messages,” “We now know this to be false,” Jordan charged.

“His conduct can only be understood as an effort to thwart the Committee’s inquiry by intentionally making false statements and representations before Congress. We therefore believe that sufficient evidence exists for DOJ to examine whether Mr. Smith’s actions warrant a charge,” the letter said.

As has happened time and again with those who engaged in lawfare against Trump, when the government was weaponized against him under the Barack Obama and Joe Biden administrations, a representative for Smith told ABC the new case now “reflects a chilling eagerness to weaponize the justice system.”

ABC confirmed, “This move by Jordan comes after Blanche said last week at his confirmation hearing that DOJ might investigate Smith over alleged perjury.”

It was Sen. Josh Hawley, R-Mo., who asked Blanche during a recent hearing whether there had been thought to prosecuting Smith for perjury.

In fact, the report said, while Smith had referenced toll data taken from telephone records of multiple members of Congress, meaning the time and location of calls, the data obtained by Smith’s team included actual content.

Reports have confirmed there’s evidence of the scope and intrusiveness of the Biden Department of Justice and FBI’s criminal investigations into Trump and hundreds of individuals and organizations in his orbit after the 2020 election.

Smith and his team peered into the text messages of 44 members of Congress, according to released documents.

Senate Judiciary Committee Chair Chuck Grassley of Iowa said in a statement that Smith, who has denied spying on lawmakers, “ran roughshod over the Constitution.”

According to a Daily Caller News Foundation report, “Smith made repeated intrusions into the communications of member of Congress, the same branch of government tasked with providing oversight of the FBI’s secret work and reining in its excesses. Members of Congress swept up in the probe include the leaders of the committees that oversee the Department of Justice: Grassley and House Judiciary Chair Jim Jordan, as well as other critics of FBI’s abuses like former House Intelligence Committee Chair Devin Nunes.”

Grassley and Senate Permanent Subcommittee on Investigations Chairman Ron Johnson released the documentation as part of an ongoing probe into the investigation the FBI codenamed “Arctic Frost” that targeted Trump and his supporters.

The allegation when the documents were released was that while the DOJ calls for filter teams to protect the constitutional rights of individuals involved in an investigation, Smith bypassed those protections.

“Jack Smith’s criminal investigation of President Trump was a runaway train that had no brakes. Based on the information that’s been produced to me and Senator Johnson, Biden DOJ and FBI investigators apparently ignored their own routine investigative protocols to obtain and review work-related messages from me and dozens of my Republican and Democrat colleagues who were outside the scope of the government’s investigation,” Grassley said.
