A federal judge appointed by Barack Obama, whose administration worked hard on the “Russiagate” conspiracy theory in its unsuccessful attempt to destroy candidate and then President Donald Trump, claims that the “8647” threat isn’t really a threat at all, just free speech.

“86” is slang for getting rid of or destroying someone, and Trump is the 47th president.

Ex-FBI chief James Comey, in fact, is facing possible federal prosecution for a social media posting where he said he found sea shells, arranged to say “8647” on a beach and he posted that online.

The latest fight was over a flag stating “8647” by the progressive group called Accountability Now USA. It posted the message on a flag on the National Mall and then sued when the National Park Service warned its permit could be revoked.

Now U.S. District Judge Randolph Moss in Washington, D.C., claims the flag, treated as a threat by the Trump administration, is protected political speech.

“This opinion is from an Obama-appointed judge,” stated an Interior Department spokesman. “Flying a flag that is a threat to the Office of the President of the United States should not be permitted under any administration.”

Moss opined that the “8647” flag does not meet the legal standard for an unprotected threat or incitement. He claimed it is neither a “true threat” nor an “incitement of violence.”

According to a report at Slay, the judge have a huge win to the activist group, which also displayed two flags accusing Trump of sexually assaulting a minor. Moss claimed those are “not legally obscene” and are protected by the First Amendment.

Moss has a long history of leftist activism. He was in the Department of Justice under Bill Clinton and has donated to and volunteered for Democrat candidates and causes over his career.

The judge’s conclusions follow the Trump administration’s efforts to watch for “8647” messaging around the National Mall.

That’s because last month, giant “8647” numbers appeared to be etched into the grass between the Washington Monument and the World War II Memorial.

Of course, Democrats for years already have been describing Trump as a “Hitler” and his supporters as “Nazis,” making the next step, threatening him, a short one.

In fact, there have been multiple assassination attempts against Trump, the latest being in April when he was attending the White House Correspondents’ Dinner.
