An appeals court in the federal system has crushed Joe Biden’s demands that he be allowed to conceal audio tapes of his interviews with a biographer.
The ruling from the U.S. Court of Appeals for the District of Columbia found he has not shown that he was likely to win the overfall fight.
A conservative think tank has requested the transcripts and audio records from the Department of Justice, containing his comments and conversations with his biographer about a decade back.
The ruling was stayed until August 3 to allow Biden to appeal further.
The decision concerns a campaign by the Heritage Foundation to obtain the government information.
The unsigned opinion said, “We conclude that Biden has not shown a likelihood that the requested materials must be withheld from disclosure.”
And it continued, “We conclude that any remaining incursion on personal privacy from disclosure of the now-redacted materials likely does not outweigh the public interest in disclosure.”
The opinion noted that the dispute already was widely publicized as the comments include those about an investigation into Biden that was done by a special counsel, who concluded by recommending no charges against Biden because a jury would view him as an old man with a faulty memory.
The opinion said the release “would bear on understanding and assessing the Special Counsel’s investigation and his ultimate decision, disclosure of the materials ‘is likely to advance’ the public interest at stake.”

A spokesman for Biden claimed the effort to release the information was part of the administration’s “weaponizing the DOJ.”
The information at issue dates back to 2016 and 2017, when Biden discussed with biographer Mark Zwonitzer information for a memoir.
They took on a new importance later, when “former special counsel Robert Hur” looked into Biden’s handling of government documents.
This happened just about the same time that Democrats were prosecuting in court President Trump on claims he did the same as Biden.
Hur’s report noted Biden’s “diminished faculties and faulty memory,” and said his conversations with Zwonitzer were “painfully slow, with Mr. Biden struggling to remember events and straining at times to read and relay his own notebook entries.”
A lower court also had declined to suppress the information.
