In her Senate confirmation hearings, Supreme Court Justice Ketnaji Brown Jackson was asked “What is a woman?” in the context of a discussion on “transgender rights.” Famously, President Biden’s then-nominee did not answer the question, explaining that she is not a biologist.

Tuesday, the high court heard a pair of cases that bring the issue of boys playing in girls’ sports into the spotlight.

During oral arguments, Jackson expressed her concern that “cisgender” girls – i.e., children with two X chromosomes, biologically and immutably female – were the only “girls” allowed to compete in girls’ sports, if the court were to rule in favor of those who favor sex-specific programs in public schools and colleges.

“We are now looking at the definition of a girl and we’re saying only people who were girl-assigned at birth qualify,” Jackson said.
