Former President Joe Biden’s attorneys on Friday filed a notice of voluntary dismissal regarding his bid to stop the Justice Department from releasing Special Counsel Robert Hur’s interview transcripts and audio recordings.

The move comes less than a week after a divided federal court denied Biden’s request for an injunction to block the release in a 2-1 split.

The court’s majority had determined Biden failed to show he was likely to succeed on the merits of his request, and the public has a strong interest in evaluating Hur’s decision not to charge him. The sole dissenter said the former president showed a “substantial privacy interest” in keeping the material hidden.

The ruling is related to recorded conversations the former president had with his biographer a decade ago that prosecutors used to conclude the former president improperly shared classified information with the author.

Hur obtained the recordings in 2023 as part of a probe that concluded Biden shared classified materials with Mark Zwonitzer in 2017. The prosecutor, however, declined to bring charges.
