Aliens in Mexico can't apply for asylum, SCOTUS rules

he U.S. Supreme Court issued its third opinion of the day in Mullin v. Al Otro Lado, a case addressing whether an alien stopped on the Mexican side of the U.S.–Mexico border has “arrived in the United States” within the meaning of the Immigration and Nationality Act (INA).

In a majority opinion authored by Justice Samuel Alito, the Court held that an alien standing in Mexico does not “arrive[] in the United States” by attempting, and failing, to enter the country. An alien “arrives in the United States” only after crossing the border.

The Court therefore held that the INA does not entitle an alien who remains in Mexico to apply for asylum or require an immigration officer to inspect him.

Justice Sotomayor filed a dissenting opinion joined by Justices Kagan and Jackson.

Justice Jackson also filed a separate dissent.

The decision is a clear victory for the Trump administration’s immigration policies.
