Defense attorney Mark Geragos told Newsmax on Monday that the accused killer of Charlie Kirk will likely be set up for trial after his preliminary hearing in the case.
On "Ed Henry The Big Take," Geragos said that a finding of "probable cause" in the case is likely.
"A probable cause proceeding is basically, I often say this: 'Is my client breathing?' So, he's going to be held to answer. There is going to be probable cause," he said.
Utah prosecutors were in court Monday seeking to convince a state judge they have enough evidence to bring the man accused of killing the conservative leader to trial and seek the death penalty.
Kirk's parents and his widow, Erika Kirk, were in the courtroom for the first time, along with Donald Trump Jr., President Donald Trump's eldest son.
Kirk's family walked out of the courtroom after the prosecution's first witness, a police officer, began testifying about Kirk's arrival at Utah Valley University in Orem the day he was shot.
The preliminary hearing will mark the most significant presentation of evidence thus far in the case against defendant Tyler Robinson.
Geragos described the work of Robinson's attorneys as methodical.
"If anybody is watching that preliminary hearing, the defense is doing a workmanlike job in trying to establish certain themes about what wasn't done, what should have been done, what could have been done," he said.
Geragos said that despite his belief the case will go to trial, there are no absolutes in a criminal proceeding.
"But beyond a reasonable doubt, don't always write this off," he said. "There are very few cases that I think are ever slam-dunk, and it'll be interesting to see how some of these things play out if you've been watching this closely."
The 23-year-old defendant is charged with aggravated murder in the Sept. 10 killing of Kirk, a Trump ally.
Robinson sat quietly between his attorneys on Monday, looking at the prosecution's exhibits on a monitor and occasionally taking notes. He wore a gray suit, and his wrists were shackled to a chain around his waist.
Prosecutors allege that he confessed in a note left for his roommate, who was also his romantic partner, that read, "I had the opportunity to take out Charlie Kirk and I'm going to take it."
The preliminary hearing is scheduled to last up to five days.
