Dershowitz to Newsmax: Laws of Perjury Should Be Applied to All

Alan Dershowitz said Thursday that perjury laws "ought to be applied equally to all," arguing during an appearance on Newsmax's "The Record With Greta Van Susteren" that public officials and judges should be held to the same legal standards as everyone else.

"I do think perjury laws are applied very selectively," the Harvard University professor emeritus said.

"And that's a very serious problem in the law. The law of perjury ought to be applied equally to all."

Pointing to Fulton County District Attorney Fani Willis, Dershowitz said, "The district attorney of Fulton County was caught in a clear, clear lie in perjury," adding that "as far as I know, she still maintains her office. She's never been prosecuted."

Dershowitz also argued that federal judge Eleanor Ross, who has been accused of misconduct should be impeached, saying the Constitution allows judges to be removed for "bad behavior."

"This is a test case for what the criteria are for impeaching a judge," he said. "Judges serve only, quote, during good behavior. That obviously is the criteria for removal."

Calling the allegations against the judge egregious, Dershowitz asked, "Can anybody imagine anything worse behavior than having loud sex in the courthouse in front of your law clerks? My God, of course she should be impeached."

He said that if he were a member of Congress, he "would move for the impeachment on the grounds of bad behavior" and "test" whether a federal judge can be removed without proving "treason, bribery, or other high crimes and misdemeanors."

Dershowitz also criticized what he described as a judiciary that is reluctant to police itself, saying, "I think we have a judiciary that is self-serving often and self-defending often."

He added that he still believes "some of the justices of the Supreme Court know who leaked the memorandum about Roe versus Wade, and they don't want an investigation because they don't want the truth."

Calling the case "such a clear case for impeachment on the ground of bad behavior," Dershowitz said, "I hope they go forward. I hope they test the case, and I would certainly be willing to help anybody who tries to get [her] impeached with the constitutional argument."
