Sen. Jim Banks, R-Ind., is introducing legislation Monday that would end birthright citizenship for children of illegal aliens and other foreign nationals by defining their parents as "invaders" under federal law, according to Fox News.
The proposal follows a Supreme Court ruling on June 30 that struck down President Donald Trump's executive order seeking to end birthright citizenship.
Days later, the president and some Republicans pushed for changes to birthright citizenship law.
"The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process," Trump wrote on Truth Social.
"No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!" he added.
"A nation without borders is not a nation," Banks wrote after the ruling, adding that Congress should pass the SAVE America Act, strengthen border security, and end what he called the "H-1B [visa] scam."
The 14th Amendment "was written to ensure equal citizenship between Americans, not to provide loopholes for illegals & birth tourists," he wrote.
"Birth tourism" refers to the practice of a foreign national visiting the U.S. with the intent to give birth to a child who is a U.S. citizen.
The 14th Amendment has long been interpreted to grant citizenship to nearly everyone born in the United States.
Banks told Fox News Digital he plans to introduce the Citizenship Act as soon as the Senate opens for business Monday afternoon.
The legislation declares that "any person who enters the United States without authorization or for the purpose of engaging in birth tourism is considered an invader" and amends the Immigration and Nationality Act to exclude children of such "invaders."
Banks told Fox News he is introducing the measure to "reverse the effects of this consequential ruling and ensure the millions of illegal aliens that invaded our country can't continue to exploit our immigration system."
