Joe Biden just suffered a devastating defeat in his desperate attempt to keep hours of private recordings out of the public’s hands.

In a stunning 2-1 ruling, a federal appeals court rejected Biden’s emergency request to stop the DOJ from turning over tapes and transcripts of his interviews with his memoir ghostwriter Mark Zwonitzer to a conservative group. Although the court did delay the ruling until August 3, so Biden can run it to the Supreme Court.

Clearly, his team is nervous, and they should be.

Of course, Americans want to know why Biden and his lawyers are fighting so hard to keep these recordings hidden… what’s in them that they don’t want us to hear?

His legal team has made a privacy argument over some of the conversations about his son Beau’s illness and death.

But here’s the thing… these weren’t random recordings that somehow wandered into a government file. Special Counsel Robert Hur got his hands on them while investigating Biden’s mishandling of classified documents. Hur relied on portions of those conversations while deciding whether the sitting president should face criminal charges.

So, that’s the big curveball for Team Sleepy Joe.

Hur’s report found that Biden read from notebooks that contained classified information while speaking with his ghostwriter. And at times, he actually read the notebooks word for word, even after stating that some of the material was classified.

In the end, Hur decided not to prosecute, mostly because Biden’s memory problems would make it harder to prove that he had acted willfully and because a jury would see him as a sad, bumbling old man.

Meanwhile, that sad bumbling old man was supposedly the leader of the most powerful nation on earth.

Apparently, Biden was too cognitively impaired for a jury to hold accountable but perfectly capable of remaining president.

This is why the public has every right to hear all the evidence that helped create that bizarre outcome.

Axios released about four minutes of audio from the October 2023 interview with Hur, and it was ghastly.

Keep in mind, this wasn’t Joe Biden years after leaving the White House. He was the sitting president at the time.

Hearing him stumble through those basic questions made the cover-up surrounding his condition feel even more dastardly. Millions of Americans had already watched him wander, mumble, freeze, and lose his train of thought in public. The media and the White House kept insisting that everything was fine and that any concern about his mental fitness was a right-wing conspiracy.

The ghostwriter tapes will likely reveal a heck of a lot more about Biden’s memory during earlier years. They will also likely clarify what classified information he openly shared and what he understood about the material and whether Hur’s decision not to charge him was justified. This could open a whole new Pandora’s Box.

And that brings us to the court ruling Team Biden is now scrambling to stop.

The Heritage Foundation went after the ghostwriter recordings through a public-records lawsuit, arguing that Americans deserve to examine key material of Hur’s classified-documents investigation.

A federal appeals court cleared the way for a conservative advocacy group to obtain copies of interviews Joe Biden privately recorded years ago for his memoir, denying the former president’s request for a temporary block.

A divided three-judge panel of the US Court of Appeals for the DC Circuit refused to stop the Justice Department from turning over the tapes and transcripts to the Heritage Foundation while Biden presses the merits of his legal challenge to the disclosure.

His lawyers still could ask all of the court’s active judges to reconsider the panel’s decision.

Yes, Joe still has a bit of legal fight left, but it’s hard to imagine the Supreme Court will side with him, although John Roberts and Amy Coney Barrett never cease to amaze us.

As far as the recordings go, they may be politically devastating. They could reveal that Biden’s memory problems started way earlier than we were told and expose how brazen his classified docs scandal really was.

Maybe they’ll also show how the machinery protected Biden from scrutiny.

The bottom line is this: when a former president’s team fights this hard to keep evidence from a completed criminal investigation hidden, people are gonna start wondering what they aren’t supposed to hear…
