The Jimmy Kimmel saga has taken a dramatic new turn.

By now you know Kimmel was pulled off the air indefinitely for shamelessly lying about Charlie Kirk’s assassination. On national television, this rabid anti-Trump radical told his audience that Charlie’s killer was part of “MAGA.” That was an outright lie. The truth is Tyler Robinson was a radical left-winger, cut from the same TDS cloth as Kimmel, and he was in a relationship with a man masquerading as a “woman.”

But things are heating up, as the backlash and anger continue to build.

Sinclair Broadcasting, the nation’s largest group of ABC affiliates, has just come out swinging against Jimmy Kimmel after his disgusting comments about Charlie Kirk’s assassination.

In a memo released on September 17, Sinclair made it crystal clear that ABC’s suspension of Jimmy Kimmel isn’t enough. They want him gone.

Let’s not forget, Kimmel was already on life support because he isn’t funny.

The program was bleeding money and ranked 53rd among ABC shows. It’s obvious network execs were already looking for a reason to cancel this loser… and they found one.

So, now, until Kimmel is fired for good, Sinclair will preempt “Jimmy Kimmel Live” and air a special in remembrance of Charlie Kirk, which they are also offering to ABC affiliates across the country.

You get the strong sense that lawsuits were about to start flying, fast and furious.

What we need to remember is that the First Amendment is not a “get out of jail free” card, especially for broadcasters who have a license to operate on the public airwaves.

The FCC has really strict rules about what can and cannot be said on national television. And when it comes to crimes and catastrophes, the rules are crystal clear: you cannot knowingly spread false information that could cause public harm.

The FCC’s policy on Broadcasting False Information states that a violation occurs when these four conditions line up:

  • The statement must be false.
  • The broadcaster must know it’s false or act with reckless disregard for the truth.
  • It must be reasonably foreseeable that broadcasting it will cause harm.
  • There must be actual harm or at least the potential for serious harm.

    So, here’s the question: did Jimmy Kimmel’s smear about Charlie Kirk’s assassination break those specific rules?

    Well, that depends on what can be proven.

    If Kimmel truly believed, without evidence, that the assassin was MAGA, that might not hit the legal threshold of “knowingly false.” If ABC can argue he was passing along what he believed to be credible information, they may try to skirt responsibility.

    But if it can be shown that Kimmel knew this was a lie or acted with reckless disregard, then his statement checks all four boxes.

    Even if the FCC doesn’t immediately move in, all of this still matters. Broadcasters live and die by their licenses, and deliberate news distortion is the kind of thing that can come back to bite networks in hearings, renewals, and legal fights. Kimmel didn’t just embarrass himself; he may have put his entire network in the FCC’s crosshairs.

    So, what a lot of people are missing here, even many on our side, is that this isn’t a First Amendment issue. This is a business decision.

    About once or twice a year, I have to explain free speech like I’m talking to a kindergarten class.

    If Jimmy Kimmel got arrested and prosecuted for what he said on his show, that’s a free speech violation.

    If his employer decides to take him off the air?

    That’s not.

    Yes, Kimmel has the right to say he hates Charlie Kirk and even mock his assassination on national television. But free speech is not freedom from consequences, especially when it violates the rules and standards broadcasters are required to follow, as well as the expectations their employers set.

    Disney is in the business of selling “entertainment,” and if their customers are angry and pushing back, they’d better pay attention. Just look at the “Snow White” fiasco; audiences rejected the woke remake, and it died in the water. The same applies to Kimmel, only this time the outrage and disgust are on an even bigger, more emotional scale.

    The First Amendment does not shield anyone from being fired if their employer decides their conduct has damaged the brand or violated policy. That is true in every sector. Fox let Tucker Carlson go. Doctors and nurses were fired during COVID simply for speaking out against the vaccine, accused of spreading “disinformation.”

    Just look what happened to Alex Jones for talking about a shooting.

    Whether those firings were fair or not is beside the point. Employers enforce their own rules, and employees face consequences when they break them. Jimmy Kimmel is no exception, especially in a capitalist society, where money is always the bottom line.
