After years of being dragged through a rigged legal circus for the crime of sharing a satirical meme, Douglass Mackey is now a free man, and he’s not wasting a second. With his conviction unanimously overturned by a panel of both right- and left-leaning judges, Mackey isn’t just walking away. He’s actually walking back into the swamp, head held high, and ready to unleash hell on the corrupt Biden DOJ and the lawfare tyrants who tried to destroy him.

After years of lawfare and media smears, Douglass Mackey has officially cleared his name. The Second Circuit Court of Appeals tossed out his conviction in a unanimous decision, delivering a stinging rebuke to the Biden DOJ’s political hit job. The court found no conspiracy, no coordination, and no legal basis for the charges, just a meme that embarrassed the regime. Now, with a clean slate and a top legal team behind him, Mackey is turning the tables on the bad guys.
Douglass Mackey, an influential political activist represented by Jones Day, successfully challenged his criminal conviction for political election memes. In 2016, Mackey posted on social media as a well-known supporter of then-candidate Donald Trump. In the days leading up to the 2016 presidential election, Mackey shared publicly available and widely circulated memes that sarcastically urged the public to vote by text for Hillary Clinton. More than four years later, but just days after President Biden’s inauguration, the government charged Mackey with conspiracy to “injure, oppress, threaten, and intimidate” persons in the exercise of their right to vote, in violation of 18 U.S.C. § 241. The government tried the case, and the jury convicted Mackey (though only after repeatedly informing the court that it had deadlocked).
On appeal, the U.S. Court of Appeals for the Second Circuit unanimously agreed with Jones Day that the conviction could not stand. Adopting Jones Day’s argument, the appellate court found that there was no evidence that Mackey coordinated with anyone to create the memes, solicited them from anyone, or in any other way collaborated on the memes. So the court held that the government failed to prove that Mackey conspired with anyone to break the law, as required for a conviction under Section 241. Because no “rational trier of fact” could have found a conspiracy beyond a reasonable doubt, Mackey carried the “heavy burden” necessary to overturn a jury verdict on sufficiency grounds. The Second Circuit thus reversed Mackey’s criminal conviction and remanded the case with instructions to enter a judgment of acquittal.

The Biden regime tried to erase Doug… but now he’s back and stronger than ever.
Sources close to Mackey say he plans to sue the DOJ for the years they stole from him, for what they did to his family, and for the message they tried to send to every American: stay silent, toe the progressive line, or we will destroy you.
And he’s not alone in calling them out. Look at this blistering X post from Chad Mizelle, the Chief of Staff at the Department of Justice under Pam Bondi.
One of the Biden DOJ’s very first actions—on January 22, 2021, just two days into the Biden administration—was to initiate a criminal prosecution to try to send a self-described X “troll” to federal prison just for posting or reposting three political memes during the 2016 presidential election (four years earlier) that could have hurt Hillary Clinton’s campaign.
Last week, almost a decade after Douglass Mackey posted those memes, the Second Circuit has rightly vacated his unjust conviction.
The Second Circuit’s decision cannot undo the last four years of the Biden DOJ’s unjust prosecution. But it is a good first step toward justice for Douglass Mackey, and @TheJusticeDept will work to ensure prosecutions like this do not happen again.

And now it’s official: Douglass Mackey is suing the DOJ for the anti-American/injustice lawfare attack they launched against him, all because he dared to mock Hillary Clinton and her train wreck of a campaign.
Douglass Mackey is a free man. Almost a decade after he posted some innocuous memes that made Hillary Clinton big mad and nearly five years after the Biden DoJ came knocking at his door because of those memes, a bipartisan panel of judges finally dismissed his absurd, unprecedented conviction for interfering in the 2016 election. But the thing isn’t over. Now it’s Mackey’s turn. The hunted becomes the hunter.
Last Monday, on Donald Trump Jr.’s show, Mackey announced his intention to sue the pants off the US government for its years of baseless persecution. Although the Biden DoJ failed to send him to prison, the process itself was punishment, designed to sap his will to live and his financial resources and make him wish he was dead.
Mackey’s been through hell—more than most could ever handle.
To pursue justice, Mackey has retained big-shot attorney James Burnham, who recently served as general counsel for DOGE, and as general counsel to the president, the DoJ’s Civil Rights Division and the Attorney General’s office.
Mackey had previously suggested he would sue the DoJ after the case was overturned (assuming it was), but by hiring Burnham, he’s sending a clear message. Burnham is a serious guy—a very serious guy—who knows just how to handle a case like this and, most importantly, how to win.
Doug took his America First, free speech warpath straight to DC, the very heart of the swamp where Biden’s regime bad guys cooked up the plan to take him down just days after Joe was installed. Think of it like a sweet revenge tour.

Nobody deserves a laugh at the expense of the tyrannical regime that tried to destroy his life more than Doug Mackey. But what happened to Doug and his young family isn’t a joke. It nearly destroyed him. And the lawfare they unleashed wasn’t just about punishing one man; it was a game plan to silence every American and bury free speech for good.

Thankfully, Doug didn’t back down. He stood against the full weight of the Deep State, and because of that, we were spared a truly chilling outcome. For now. Because let this be a very sobering reminder that our freedoms, which should be carved in stone, actually aren’t. Especially when anti-American cronies like Biden’s DOJ are given power.
So congratulations to Douglass Mackey on his massive win, and good luck as he sets his sights on the bad guys who tried, and failed, to destroy him.
