Feds sued by Illinois AG, Chicago over ‘abusive’ actions by DHS agents

CHICAGO (NewsNation) — The City of Chicago has joined a federal lawsuit filed Monday by Illinois Attorney General Kwame Raoul, which characterizes the actions of federal immigration agents and officers in Chicago last fall as unlawful and abusive.

Mayor Brandon Johnson’s office said the administration is moving swiftly to hold the federal government accountable for its “reckless overreach, which has put families at risk, undermined public safety efforts and sparked chaos and fear” in Chicago communities.

Johnson’s office referred to a two-month immigration enforcement operation as “militarized” and accused the Trump administration of overseeing abusive and unlawful enforcement tactics. The mayor also says the Trump administration’s use of Customs and Border Protection and Immigration and Customs Enforcement officers has led to repeated rights violations committed by federal agents and officers.

The Department of Homeland Security has announced more than 4,300 arrests during the immigration enforcement operation. The lawsuit was filed as DHS announced Monday it has made more than 2,000 arrests in Minneapolis, where 37-year-old Renee Good was shot and killed by an ICE officer last week. The agency announced Monday that an additional 1,000 officers are being sent to Minneapolis.

DHS Secretary Kristi Noem and Border Patrol commander-at-large Gregory Bovino are among those listed as defendants. Noem and Bovino were also listed as defendants in a federal lawsuit filed in the fall by several Chicago journalism organizations, clergy and protesters seeking protection from the officers and federal immigration officers and agents.

Minnesota state officials also filed a federal lawsuit against Noem and others attempting to block the surge of more federal agents and officers to Minneapolis.

Johnson said in a statement announcing the lawsuit that the Trump administration has repeatedly violated the law and undermined public trust. Johnson and Illinois Gov. JB Pritzker have remained constant targets of President Donald Trump, who has said that the two Democrats should be in jail for their stance in not cooperating with federal agencies.

“These actions (by federal agents) weren’t just unlawful,” Johnson said in a statement Monday. “They were cruel, needlessly inflicting fear and harm on our communities.”

DHS spokesperson Tricia McLaughlin referred to the lawsuit as “baseless” and accused Democrats of “miraculously” rediscovering the 10th Amendment when they did not want federal immigration laws enforced.

“The fact is that sanctuary politicians in Illinois and Chicago released violent criminals, including murderers, rapists, drug dealers, pedophiles, gang members, and terrorists, onto its streets and their dereliction of duty cost lives,” McLaughlin said in a statement released to NewsNation Monday.

Raoul filed the lawsuit Monday, arguing the Trump administration’s “menacing, violent and unlawful incursion” while characterizing the operation as immigration enforcement in unconstitutional.

“Border Patrol officers agents and ICE officers have acted as occupiers rather than officers of the law,” Raoul said in a statement announcing the 103-page lawsuit. “They randomly, and often violently, question residents. Without warrants or probable cause, they brutally detain citizens and non-citizens alike.”

Raoul also accused agents of using tear gas and other chemical agents against bystanders and children. He said he filed the lawsuit to stand up for the people of Illinois and the state’s sovereignty.

The lawsuit also challenges the Trump administration’s “arbitrary enforcement actions” at or around schools and shelters. Raoul also accuses DHS officers and agents of trespassing on private and government-owned property, among other unlawful actions.

The Trump administration has implemented these policies to coerce the plaintiffs to abandon their policies, which value and respect immigrants, and devote their resources to further the immigration policies of the current administration, Raoul alleges in the lawsuit.
