Charlie Kirk case: Judge to rule on prosecutor pretrial comments

(NewsNation) — A Utah judge is set to rule Monday on whether prosecutors will face sanctions for comments to the media about a bullet fragment recovered from Charlie Kirk’s body.

The contempt question centers on whether Utah County prosecutors violated pretrial publicity rules when Deputy Utah County Attorney Christopher Ballard made comments about ballistics evidence in to news outlets.

Defense lawyers for Tyler Robinson, who is accused in Kirk’s killing, took issue with public statements Ballard made, including an interview on “Fox & Friends,” and said prosecutors must hand over all internal communications regarding media outreach.

As a remedy for the alleged violations, Robinson’s attorneys asked the judge to prohibit prosecutors from seeking the death penalty.

Ballard testified that court rules allowed him to speak with media outlets to counter what he viewed as misinformation about evidence in the case. He said he only spoke generally about how ballistics testing can be inconclusive, not about case specifics.

Robinson has not entered a plea. A key preliminary hearing, where prosecutors must show they have enough evidence for a trial, is set to begin July 6.

Meanwhile, a separate court filing revealed the suspect’s roommate and reported romantic partner, Lance Twiggs, gave investigators a recorded statement under oath after Robinson turned himself in.

Twiggs told them about messages in which Robinson allegedly admitted to killing Kirk.

In exchange, Twiggs received limited immunity from the U.S. Attorney’s Office and Utah County Attorney’s Office, meaning his statements can’t be used against him personally.

Twiggs was also named as a possible witness for an upcoming preliminary hearing. The defense filed to secure him as an out-of-state witness back on June 11.

The roommate has not been certified or ordered to appear at Robinson’s preliminary hearing, and the court has not made a decision on either.

Robinson, 23, is accused of shooting and killing Kirk on the Utah Valley University campus Sept. 10 and faces charges, including aggravated murder.
