Prosecutors Drop Final Weinstein Rape Charge

Manhattan prosecutors have dropped plans to retry Harvey Weinstein on a third-degree rape charge after the woman at the center of the allegation told prosecutors she did not want to testify again, bringing an end to the final unresolved criminal charge against the former Hollywood producer in New York.

Manhattan District Attorney Alvin Bragg announced Wednesday that his office would not pursue another trial on the remaining count involving accuser Jessica Mann after a jury failed to reach a verdict during Weinstein's retrial in May.

Bragg said the decision came after prosecutors consulted with Mann, who decided she would not participate in another trial.

"In accordance with our survivor-centered approach to prosecutions, we informed the court that we will not retry the remaining count" of third-degree rape, the district attorney's office said.

"To be clear, we believe Ms. Mann's account and her credibility as a witness."

The office also described the case as an "extraordinarily taxing ordeal" for Mann, noting that she testified before two grand juries and three trial juries over eight years. Prosecutors thanked her for what they called her honesty and courage throughout the proceedings.

In a statement submitted to the court, Mann said she made the decision to end her participation after concluding she could no longer withstand another trial.

"It was clear to me at this last trial I could no longer endure going through this any longer," Mann said. "In my fight to see justice, it has nearly stolen a decade of my life and put me through more harm than good."

She said the experience had changed her "in irrevocable ways" and came at a personal cost "that there is no restitution for."

Weinstein spokesman Juda Engelmayer said the former film producer welcomed prosecutors' decision.

"Harvey is relieved by today's outcome," Engelmayer said in a statement.

"We believe this is the result that should have been reached from the outset, had the grand jury been presented with the full scope of the emails, text messages, and other private communications."

The rape charge was left unresolved after jurors convicted Weinstein on one count of criminal sexual act and acquitted him on another count during his retrial in May but could not reach a unanimous verdict on Mann's allegation.

Weinstein, 74, has denied sexually assaulting anyone and has maintained that all of his sexual encounters were consensual.

The retrial was ordered after New York's highest court overturned Weinstein's landmark 2020 conviction in 2024, finding that testimony from women whose allegations were not part of the criminal charges should not have been admitted.
