UPDATED: Biden Ghostwriter Tapes, Transcripts Are Out - and They're Already Raising Big Questions

The Oversight Project has released transcripts of the audio interviews between Joe Biden and Marc Zwonitzer that took place in 2016 and 2017. They're all in one PDF document but cover the entire interview series, and are embedded at the end of the piece.

ORIGINAL STORY

On Monday morning a federal judge dissolved an injunction blocking the release of transcripts and audio recordings of conversations between Joe Biden and his ghostwriter, Marc Zwonitzer that occurred in 2016 and 2017. The Heritage Foundation sought their release as part of a Freedom of Information Act request, since they were cited in Special Counsel Robert Hur's report as a reason Biden was not charged with crimes related to mishandling classified information.

That audio has now been released; you can listen for yourself here.

Hur said in his 2024 report:

“. . . Mr. Biden’s memory was significantly limited, both during his recorded interviews with the ghostwriter in 2017, and in his interview with our office in 2023.”

"Mr. Biden’s memory also appeared to have significant limitations..."

“Mr. Biden’s recorded conversations with Zwonitzer from 2017 are often painfully slow, with Mr. Biden struggling to remember events and straining at times to read and relay his own notebook entries.”

Earlier in the day, prior to posting the audio, Oversight Project VP of Litigation Jeff Clark posted two takeaways. The first was that the audio reveals that "Biden disclosed massive amounts of classified information to his ghostwriter."

Under federal law, Clark asks why Hur, an officer of the court, didn't file charges.

But I want to make this point right now. The tapes make clear that Biden disclosed massive amounts of classified information to his ghost writer Marc Zwonitzer.

Now, take a look at 18 USC 798(d).

Last, ask yourself, why didn't Special Counsel Robert Hur seek a prosecution and then (A) the forfeiture the $8 million book advance that Joe Biden got for Promise Me, Dad; and (B) his Delaware house and any other Biden property where he kept classified information?

(1)Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—

(A)any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation; and

(B)any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

Clark also observed that, from his review of the tapes, Biden's argument that the release of the tapes would publicize private family matters was "a massive misdirection play" and that "The lion's share of these documents we just got are about the illegal retention of classified information, which was unsurprisingly the subject of Robert Hur's Special Counsel probe."

Here's my second meta-point about the Biden tapes we got today after two years of stonewalling, first by the Biden DOJ, and then by Biden's high-priced private lawyers trying to pretend that that DOJ was a pure as the driven snow:

I've listened to a fair amount of the tapes at this point and so far I have not come across anything that deals with a private family matter.

So I conclude the privacy angle was by and large a massive misdirection play.

The lion's share of these documents we just got are about the illegal retention of classified information, which was unsurprisingly the subject of Robert Hur's Special Counsel probe.

Massive amounts of our lawyer time was wasted arguing about a legal feint organized by Joe Biden's lawyers.

Forcing The Heritage Foundation to incur massive legal expenses to defend against a spurious argument should lead to sanctions against those attorneys. But for now, it's incredible to finally have some transparency.
