Judge Sullivan’s ruling is grounded in a 2020 settlement agreement between USPS and the NAACP. This agreement ensures that USPS delivers mail-in ballots efficiently and reliably, under court oversight. According to Breitbart, the judge stated, “The Proposed Rule violates paragraph 2 of the Agreement because the Postal Service cannot post documents reflecting ‘practices and policies for prioritizing the monitoring and timely delivery of Election Mail’ if its policies provide that it will not accept ‘noncompliant mailing’ and therefore will not deliver mail-in or absentee ballots to some voters.”

President Trump’s executive order, titled “ENSURING CITIZENSHIP VERIFICATION AND INTEGRITY IN FEDERAL ELECTIONS,” aimed to prevent voter fraud and enhance election integrity. The order required states to provide a “Mail-In and Absentee Participation List” and outlined packaging requirements for mail-in ballots. It also called for secure ballot envelope identifiers, such as barcodes, to confirm that only citizens receive and cast ballots. Per Fox News Politics, Postmaster General David Steiner supported the rule, stating, “That is what our proposed rules suggest, is that we have unique barcode, unique envelope.”

The ruling extends nationwide, affecting over two dozen states that challenged the executive order.
