California Breaks from CDC on Vaccine Guidance

California Gov. Gavin Newsom last week signed a sweeping California vaccine law that transfers authority over immunization guidance from federal regulators to the state. The move makes California the first state to set its vaccine policies independently of the Centers for Disease Control and Prevention (CDC), relying instead on professional groups like the American Academy of Pediatrics (AAP), the American Academy of Family Physicians (AAFP), and the American College of Obstetricians and Gynecologists (ACOG).

The law, signed on Sept. 17, locks in federal vaccine recommendations as they stood on Jan. 1, 2025, while granting California’s Department of Public Health the power to adopt new guidelines issued by these professional organizations. Almost immediately, California joined Hawaii, Oregon, and Washington in releasing joint vaccine recommendations for the fall respiratory illness season—endorsing COVID-19, flu, and RSV shots for children, infants, and at-risk groups.

West Coast Alliance Challenges the CDC

The four Democrat-led states formed the West Coast Health Alliance earlier this month, explicitly positioning themselves as an alternative to the CDC. In their words, the coalition was created to “uphold scientific integrity in public health as Trump destroys CDC’s credibility.”

But federal officials pushed back hard. U.S. Department of Health and Human Services (HHS) Communications Director Andrew Nixon said the states undermined trust during the pandemic with school lockdowns, mask mandates, and vaccine passports, and argued the CDC’s Advisory Committee on Immunization Practices (ACIP) remains the nation’s scientific authority on vaccines.

Parents Fear Fewer Options

Critics warn the California vaccine law could significantly restrict parents’ ability to seek exemptions. California already bars religious exemptions, and now, under the new law, medical exemptions must meet AAP criteria—a standard some argue is narrower and more rigid than the CDC’s.

Tracy Slepcevic, president of Autism Health and mother of a vaccine-injured child, described the law as government overreach. “Parents are now being forced into a corner: homeschool your kids or comply with state vaccine mandates,” she wrote.

Insurance, Liability, and Legal Gray Areas

Another key provision directs California health insurers to cover vaccines recommended by the state, even if the CDC no longer endorses them. But there’s a catch: vaccines not on the CDC’s official immunization schedule are not covered by the federal Vaccines for Children Program, and they may not be shielded from liability protections under the National Childhood Vaccine Injury Act of 1986.

That means pharmaceutical companies producing shots outside the CDC schedule could lose the immunity they’ve relied on for decades. HHS Secretary Robert F. Kennedy Jr. noted that liability shields may not apply if California or the AAP recommends a vaccine the CDC does not. “AAP should also be candid with doctors and hospitals that recommendations that diverge from the CDC’s official list are not shielded,” he warned.

Although COVID-19 vaccines are still protected under the separate PREP Act, which runs through 2029, legal experts suggest the state’s new direction could test the boundaries of those protections.

A National Flashpoint

This California vaccine law sets up a direct clash between state authority and federal guidance, raising questions about liability, insurance, and parental rights. It also adds to the growing polarization of public health: Democrat-led states are moving to chart their own course, while federal officials insist the CDC must remain the final word.

At the center of this debate are American parents, many of whom feel trapped between mandates, shifting science, and diminished trust in public health institutions. For some, California’s move represents a local solution. For others, it’s a dangerous precedent that erodes the balance between parental authority and government control.
